Please read these Terms and Conditions of transaction (hereinafter referred to as "Terms and Conditions") carefully before ordering any goods on mfitcares.com.
1. Scope of application
1.1. Shopping for products on the website mfitcares.com.
1.2. Goods applied and deployed at Website mfitcares.com are goods and products in the business registration that M FIT is applying.
1.3. Having the need to have Products delivered to locations that comply with the Delivery Policy posted on the Website.
2.Order establishment and cancellation on mfitcares.com
2.1. Establishment of a purchase and sale contract on mfitcares.com
- All product information provided on the Website mfitcares.com shall in no event be construed as M FIT's offer to enter into a contract with the Customer.
- Customer's order on the Website will form a purchase order (Order). M FIT sends confirmation of the Order through one of the following forms:
• Via the email address that the Customer has registered with the content: product list, delivery time, contact phone number, recipient information, orderer, payment value…
• Via updating the order status in the Customer's account management system on the Website with the content Order has been confirmed, or content with equivalent meaning.
• Calling the Customer to confirm the order.
• During the processing of the Customer's Order, M FIT has the right not to confirm part or all of the Order in some cases including but not limited to:
o M FIT cannot meet part or all of the transaction conditions in the Customer's Order due to objective reasons or technical errors from the system.
o M FIT suspects that there is speculation for profit from the Customer (the concept of speculation is specified in clause 2.2 below).
2.2. M FIT has the right to cancel the confirmed Order in the following cases:
- When M FIT believes that the Customer shows signs of:
• Speculation (understood as the Customer taking advantage of M FIT's sales policies to order in large quantities and/or not for the purpose of final consumption but to buy and sell again, in order to seek benefits).
• Using loopholes, system errors, errors, confusion leading to incorrect Product information (including but not limited to price, delivery conditions, inventory status, characteristics, types of Products, conditions and incentives attached to the Product) in the process of M FIT's transaction to purchase goods in order to receive higher benefits than normal.
• Violating the provisions of the Promotion Policy specified in Section 2.3 of these Terms and Conditions.
• When M FIT or M FIT's delivery staff cannot contact the Customer from three (03) times or more within 15 minutes due to the Customer's subjective reasons from the time of starting to contact for delivery.
- When Force Majeure affecting the performance of M FIT's Order occurs and lasts for more than twenty-four (24) hours from the time Force Majeure begins, M FIT will use all methods and make maximum efforts to notify the Customer of this situation and propose a new Order execution time. In case the Customer does not agree with M FIT's proposal, they can actively cancel the Order or M FIT will actively cancel it.
- Cases where M FIT has grounds to determine that the Contract is invalid according to the provisions of law.
In the event that a confirmed Order is partially or fully canceled, the amount the Customer has paid for the canceled Order will be refunded to the Customer in accordance with the return policy posted on the Website.
2.3. To ensure fairness and the rights of Customers as end consumers, M FIT has the right to apply conditions restricting the implementation of promotional programs (“Promotions”), including but not limited to:
• Limits on the maximum number of Products in each Promotion that a Customer can purchase.
• Limits on the purpose of purchasing Products, whereby Products purchased in Promotions may only be used for consumption and may not be traded, resold, or transferred in any form.
• Other restrictions (if any) are specified in each Promotion. The conditions restricting the implementation of Promotions are hereinafter referred to as the Promotion Policy.
Therefore, M FIT has the right not to confirm, refuse, cancel, or recover Products that have been delivered for Orders that violate any content of the Promotion Policy without notice to the Customer. For clarification, an Order that violates the Promotion Policy is an Order that violates due to one or a group of Customers related to each other, using one or more accounts on M FIT to order Products with Promotions applied. M FIT will use its tools to verify and has full discretion to decide whether that Order violates the Promotion Policy or not.
3. Prices, VAT invoices, and payment
Please complete full payment before your order is processed and shipped. We accept payment via credit card, bank transfer, e-wallet, or cash on delivery (COD).
3.1. The price of the Product includes value-added tax. In all cases, the price of the Product does not include shipping fees. Shipping costs are specifically stated in the delivery policy posted on the Website.
3.2. Customers have the right to request an invoice and receive a valid financial invoice for the Order by clicking on the "Issue invoice for order" box before making payment. Customers are responsible for providing complete and accurate information for issuing financial invoices. M FIT will not support any requests to change/modify information on VAT invoices from Customers after the invoice has been issued. The invoiced value equals the value of the goods paid in cash and by transfer.
(*) Note: In all cases, M FIT does not support splitting/merging multiple Orders and issuing VAT invoices for these split/merged Orders.
3.3. Customers pay the value of the Order as stipulated in the delivery policy and payment policy posted on the Website before receiving the Product of that Order. When the Customer clicks on the "Confirm order" box to proceed with payment for the Order, it means that (i) the Customer confirms that they have reviewed the Order information; and (ii) the Customer agrees that the Terms and Conditions will apply to the transaction of purchasing Products in that Order.
3.4. To ensure payment security, Customers should note:
• Only make online payments at the linked window from M FIT.
• Use and store cards carefully (credit cards, ATM cards, etc.), and keep account/card information secure.
• Do not lend or allow others to use cards/accounts to purchase goods at M FIT. As soon as any unusual transactions are detected at M FIT, Customers need to contact M FIT's Customer Service Center immediately for timely processing. In all cases, with international credit/debit cards, Customers please do not reveal the CVV/CVC/CSC number (which is the security code, a set of three numerical characters printed on the back of the card) to protect card information.
4. Product delivery
4.1. The Product will be delivered to the address requested by the Customer in the Order at the time specified in the Delivery Policy posted on the Website or at the time the Customer requests to receive the goods, provided that this delivery time is consistent with that Delivery Policy.
In the event that the Customer wants to change the recipient, the Customer must call the Customer Care switchboard to notify the name and contact phone number of the person designated by the Customer to receive the Product as well as the Product receiving address. The person designated by the Customer to receive the Product on the Order or by telephone as prescribed in this Article 4.1 is collectively referred to as the "Recipient". Customers are not allowed to change the receiving address.
The address already declared on the system cannot be changed under any circumstances.
4.2. Regulations on checking Products upon receipt are specified in the Delivery Policy posted on the Website.
The risk and ownership of the Product will be transferred to the Customer from the time the Recipient signs the order invoice. Customers need to keep the order invoice for comparison or to resolve any problems that may arise related to the Product (if any).
4.3. Standard delivery time is 2–3 business days (excluding weekends and public holidays). We strive to deliver on time, but delays may occur due to unforeseen circumstances such as weather conditions, natural disasters, or shipping disruptions.
5. Product exchange, return and refund
You may request a return or refund within 30 days if the product is not of satisfactory quality. Please contact us via email or hotline for prompt and convenient support.
6. Purchase discount incentives
Regulations on discount incentives when shopping at the website mfitcares.com are implemented according to M FIT's incentive policy at each time.
7. Customer care and complaint handling
In case of any questions or complaints, including but not limited to the quality of goods/services, Product delivery, delivery staff attitude, Product exchange/return... Customers can contact the Customer Care switchboard. When contacting, Customers must provide the Order number. Customer Care staff will receive and respond to Customers as soon as possible.
8. Limitation of liability
In any case, M FIT is not responsible for any damage/loss/harm/damage that the Customer suffers after the risk is transferred from M FIT to the Customer, unless caused by M FIT's fault.
9. General terms
9.1. The regulations referred to in these Terms and Conditions are an integral part of these Terms and Conditions. If there is any inconsistency between these Terms and Conditions and any other regulations on the same content, the content of these Terms and Conditions will be given priority.
9.2. M FIT and Customers when accessing and purchasing goods on mfitcares.com means agreeing to fulfill all obligations specified in these Terms and Conditions. M FIT has the right to change, modify, add or remove any part of these Terms and Conditions, depending on the time. The changes will take effect immediately upon being officially updated on the Website and do not need to be notified in advance, when the Customer continues to conduct transactions through M FIT after the new Terms and Conditions take effect, it means that the Customer accepts those changes. Once again, M FIT notes: Customers please update regularly or read the Terms and Conditions carefully before making transactions.
9.3 If any content of these Terms and Conditions is deemed invalid or unenforceable in whole or in part by any competent authority, the validity of the other content in these Terms and Conditions will not be affected.
9.4. These Terms and Conditions and any issues arising in the contractual relationship between M FIT and the Customer shall be construed and governed by the laws of Vietnam. Any disputes, differences, or claims arising from or relating to the content of these Terms and Conditions shall be resolved through amicable negotiation in good faith within thirty (30) days. If resolution is not possible within this thirty (30) day period, the dispute or claim may be resolved by a competent court.
